If I am on Workers’ Compensation, does that affect my SSD claim?

Maybe. It is possible to receive Workers’ Compensation and disability benefits at the same time. Based on past earnings, you have a maximum benefit amount. This is the amount you are entitled to receive between the two benefits. The theory is that one will not be better off financially if they are disabled than they were when they were working.
If Work Comp benefits and disability benefits exceed the monthly maximum benefit amount, the Social Security benefits will be offset. It is important to speak to your attorney about the dynamic between your Work Comp benefits and disability benefits to ensure your benefits are maximized.

Does this apply to every state? My brother has to be on both workers' compensation and social security. Due to some unfortunate circumstances, that is the only way he can pay his bills. I would hate for him to lose the benefits that he rightfully deserves. http://www.sandiegoworkerscompensation.com

ReplyDeleteThat is good to know that there is a level where the two compensations can actually work together for you. My wife was recently injured at work. We were trying to see how to work with workers compensation and whether or not it would hurt her social security check. I am super glad that there is a way to work with both and realistically keep both.

This is what my brother was wondering with being eligible for both a workers compensation and disability benefits at the same time. Perhaps in special cases, like you mentioned in the first paragraph, where it's based on past earnings and the maximum benefit amount with each case. We're still going to try to see what our options are for being eligible for workers compensation.
